By accessing and using outdoormediainsights.com (the “Site”), operated by Dynamics Southwest, Inc., a Texas corporation doing business as DSWi and as Outdoor Media Insights (“we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, do not access the Site.

Outdoor Media Insights is a software solution for out-of-home and outdoor advertising businesses, built to natively extend Microsoft Dynamics 365 Business Central. This Site is a marketing and informational resource. Your use of the Outdoor Media Insights software, and any demo, trial, or subscription, is governed by a separate written agreement between you and Dynamics Southwest, Inc., not by these Terms.

Unless otherwise indicated, the Site and all content, features, and functionality, including text, graphics, logos, and design, are owned by Dynamics Southwest, Inc., its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. Microsoft, Microsoft Dynamics 365, and Business Central are trademarks of Microsoft Corporation, used here for identification only. You may not copy, reproduce, republish, or distribute any part of the Site without our prior written permission.

By using the Site, you represent and warrant that:

• You have the legal capacity to accept these Terms.
• You are not a minor in the jurisdiction in which you reside.
• You will not access the Site through automated or non-human means.
• You will not use the Site for any illegal or unauthorized purpose.
• Your use of the Site will not violate any applicable law or regulation.

You may not access or use the Site for any purpose other than that for which we make it available. Prohibited activities include, but are not limited to:

• Systematically retrieving data or content to create a collection or database without our written permission.
• Making unauthorized use of the Site, including collecting names, email addresses, or other contact information.
• Circumventing, disabling, or interfering with security-related features of the Site.
• Engaging in unauthorized framing of or linking to the Site.
• Tricking, defrauding, or misleading us or other users.
• Interfering with or disrupting the Site or the networks connected to it.

If you send us information through the Site, such as a demo request, a resource download, or any feedback, questions, or suggestions (“Submissions”), you agree that we may use and share your Submissions for any lawful business purpose without obligation or compensation to you. You represent that your Submissions are your own and do not violate the rights of any third party.

The Site may contain links to third-party websites or services, including the DSWi corporate website at dswius.com and Microsoft resources, that we do not own or control. We are not responsible for the content, privacy policies, or practices of any third-party websites or services, and you access them at your own risk.

In no event will we or our directors, officers, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or loss of data, arising from your use of the Site, even if we have been advised of the possibility of such damages.

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

We reserve the right, in our sole discretion, to change or modify these Terms at any time. We will alert you to changes by updating the “Last updated” date. Your continued use of the Site after any change constitutes acceptance of the revised Terms. Please review these Terms periodically.
